Connecticut Prohibits Questions about Age on Initial Job Applications

A law in Connecticut that takes effect on October 1, 2021 – “An Act Deterring Age Discrimination In Employment Applications” (Senate Bill No. 56 / Public Act No. 21-69) – will prohibit Connecticut employers with three or more employees from inquiring into the age of applicants on initial job applications to deter age discrimination.

Under the Act signed by Connecticut Governor Ned Lamont on June 24, 2021, employers – either directly or through a third party – may not ask applicants about their age, date of birth (DOB), dates of attendance at an educational institution, or dates of graduation from an educational institution on initial job applications.

However, the Act introduced by the Aging Committee would allow a Connecticut employer to request or require such prohibited information if the request or requirement was based on a bona fide occupational qualification or need, or the employer had a need for such information to comply with applicable state or federal laws.

The Age Discrimination in Employment Act (ADEA) of 1967 prohibits employment discrimination against persons 40 years of age or older. The ADEA is enforced by the U.S. Equal Employment Opportunity Commission (EEOC), a government agency that enforces federal laws prohibiting discrimination in the workplace.
