Louisiana Governor John Bel Edwards has signed House Bill 266 (HB266) into law to “Ban the Box” on some state job applications by removing the question asking applicants about their criminal history to help give them a fair chance at employment. This new Ban the Box law will take effect August 1, 2016.
HB266 prevents state employers from asking applicants about criminal history in the application phase so they may explain such records during the interview. However, the Ban the Box law allows employers to ask about criminal history during interviews and perform criminal background checks on applicants.
As reported earlier by ESR News, the Louisiana State Legislature passed the Ban the Box legislation in May 2016. Introduced by Representative Denise Marcelle (D – District 61), the new Ban the Box law will enact Chapter 29 of Title 42 of the Louisiana Revised Statutes of 1950, to be comprised of R.S. 42:1701.
Louisiana joins several other states with some form of Ban the Box laws. These states include California, Colorado, Connecticut, Delaware, Georgia, Hawaii, Illinois, Maryland, Massachusetts, Minnesota, Missouri, Nebraska, New Jersey, New Mexico, Ohio, Oregon, Rhode Island, Vermont, and Virginia.
